Who has to file Modelo 210 for a rented property in Spain?

This is the first question almost every overseas owner asks, and the answer does not depend on your passport.

Modelo 210 is the Spanish non-resident income tax return (IRNR). It is filed by anyone who is not tax resident in Spain but earns income here, the most common case being an owner who lives abroad and rents out a property in Spain.

What matters is tax residency, not nationality. Someone who lives in Spain year round declares through the resident system (IRPF) instead.

Whether you count as resident in a given year can be genuinely unclear, and that determination belongs to a gestoría or tax adviser rather than to software.
