Where does the deposit actually go, and who is responsible for lodging it?

  The deposit is not held by the landlord. It is lodged with a body of the autonomous region where the property sits. The duty falls on the landlord, not on the tenant and not on the agency, even where an agency handles the paperwork in practice.

  Which body and which deadline depend on the region. In the Comunidad de Madrid it is the Agencia de Vivienda Social, formerly the IVIMA, and the deadline is 30 working days from the day after signature. Andalusia, Valencia and Catalonia each have their own body and their own deadline.

  This catches overseas owners more often than anything else, simply because nothing equivalent exists at home. Which body covers your property, and whether your deadline is still open, is something a gestoría reads off the contract.
