My letting agent handles everything. What still counts as my responsibility?

  An agency can carry out almost every task, but the legal duties of a landlord stay with the owner. Lodging the deposit with the regional body is the landlord's obligation. Filing Modelo 210 on the rental income is the owner's obligation. The obligations under the tenancy itself, such as keeping the property habitable, are the owner's too.

  What an agency changes is who does the work, not who answers for it. If the deposit is never lodged, the surcharge lands on the owner, not on the agency, whatever the management contract says between the two of you.

  So the useful question when reading a management agreement is not what the agency will do, but what it undertakes to be liable for if it fails to do it. That distinction is worth having someone read the agreement for, before signing rather than after.
